By accessing or using the WorldPulse website (worldxpulse.com) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms apply to all visitors, users, and customers of WorldPulse.
2. Description of Services
WorldPulse provides a platform for creating, managing, and sharing Digital Product Passports (DPPs). Our services include data mapping, passport design, QR code generation, and compliance tools for the EU Ecodesign for Sustainable Products Regulation (ESPR) and related frameworks.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete information when creating an account.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the services for any unlawful purpose or in violation of any applicable regulations.
- Upload false, misleading, or fraudulent product information to Digital Product Passports.
- Attempt to gain unauthorized access to any part of the platform or its systems.
- Interfere with or disrupt the integrity or performance of the services.
- Reproduce, duplicate, copy, sell, or resell any portion of the services without express written permission.
5. Intellectual Property
The WorldPulse platform, including its design, code, branding, and documentation, is owned by WorldPulse and protected by intellectual property laws. You retain ownership of any product data, images, and content you upload to the platform. By uploading content, you grant WorldPulse a license to host, display, and distribute that content solely for the purpose of providing the services.
6. Digital Product Passports
- You are solely responsible for the accuracy and completeness of product information entered into any Digital Product Passport.
- WorldPulse does not independently verify the claims, certifications, or supply chain data you provide.
- Digital Product Passports created on our platform are intended to support transparency and regulatory compliance but do not constitute legal certification.
7. Payment and Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Free tiers and trial periods may be modified or discontinued at any time.
8. Limitation of Liability
To the maximum extent permitted by law, WorldPulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the services. Our total liability for any claim related to the services shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Disclaimer of Warranties
The services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the services will be uninterrupted, error-free, or that they will meet any specific regulatory requirements in your jurisdiction.
10. Termination
We may suspend or terminate your access to the services at any time for violation of these terms or for any other reason with reasonable notice. You may cancel your account at any time by contacting us. Upon termination, your right to use the services ceases immediately, though we may retain certain data as required by law or regulation.
11. Governing Law
These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the services shall be resolved through good-faith negotiation before pursuing formal proceedings.
12. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Material changes will be communicated via email or a prominent notice on the website. Your continued use of the services after changes take effect constitutes acceptance of the revised terms.
